PIL to remove kejriwal from CM post rejected
A person named as Surjeet singh has filed a PIL in Delhi high court. The PIL is filed to remove Delhi CM Arvind kejriwal from his post of CM. As we know he is arrested and is in jail for liquor scam. His remand is extended till April 4 by the Court. He will be in remand till 1st April 2024.

On Thursday, the Delhi High Court dismissed a Public Interest Litigation (PIL) seeking the removal of Arvind Kejriwal from his position as Chief Minister of Delhi. Kejriwal had been arrested by the Enforcement Directorate (ED) in connection with the liquor policy case. A division bench, consisting of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora, ruled that the petitioner failed to demonstrate any legal prohibition preventing an arrested Chief Minister from holding office. The bench requested the petitioner to present any legal barriers they were asserting.

The plea was filed by Surjit Singh Yadav, a Delhi resident who claimed to be a farmer and social worker. Yadav argued that a Chief Minister accused of involvement in a financial scandal should not be allowed to remain in public office. Currently, Kejriwal is in ED custody, which is scheduled to end today. He will be presented before the city’s Rouse Avenue Courts later today. In the PIL, Yadav contended that Kejriwal’s continued tenure in office would not only impede the due process of law but also disrupt the normal functioning of government machinery.
Delhi high court rejected it saying that it is not good to interfere in this matter.
The plea stated, “The Respondent No.4 has virtually forfeited his office as a Chief Minister on account of being arrested, and as he is in custody, he has disabled himself from performing the duties and responsibilities of being a public servant. As such, he ought not to continue as a Chief Minister.”
It’s worth noting that AAP Ministers have been making statements in the media asserting that Kejriwal will not resign from his post, and if necessary, he will continue to govern from inside the prison.
