Rajashthan court notice on GST issues

Hon’ble Rajasthan High Court today issued show cause notices to CG& SG on the Writ Petition. This petition was filed by Rajasthan Tax Consultants Association. It was in respect of several issues under GST including

– modification of compliance requirements;

– not charging interest, penalty;

– retrospective effect to late fee waiver;

– composition window related problem,

– opting out problem,

– Trans Form Problems,

– input credit problems,

– TRAN1 utility made available late etc.

The Govts have to respond by 13th September and now matter would be heard on 13th.

Advocate Sanjay Jhanwar (Chir Amrit) argued that while he is great supporter of GST, however when GST portal is not ready and Govts are not ready and there are number of glitches in the system, then how the “clinical trial” of a new system can be thrusted upon the businessman, at the cost, inconvenience & peril of the taxpayer.

Hon’ble Court has also issued show cause notices on stay application of RTCA.
