Landmark order by Rajasthan High Court in the case argued by Shri Jai Mittal Advocate

Good News: Today’s, after two days of hearing the D.B. Writ Petition No. 2031/2018, the Hon’ble Rajasthan High Court pass an order directed the Central Government to hold the inquiry and take action against officers of DGGSTI for conducting vexatious search conducted under Central Excise Act. The Rajasthan High Court also pass an order not to take any coercive measure and observed that after the introduction of the GST, the officers appointed under section 3 and 5 of  CGST has no power to take action against the Central Excise Act and Section 12F of Central Excise Act, 1944 recourse is not available. Yesterday while hearing the said matters said the entire action is without jurisdiction and without authority of law. The matter is now posted now in September 2018. The Landmark order by Rajasthan High Court is given.
