Gujarat high court ordered not to take any coercive steps for recovery for 16(4) Notice

Happy to share an update with regards to Section 16(4) of the CGST Act. This is being shared for the benefit of one and all.

The petitioner received Notice and was asked to pay the amount equivalent to ITC availed in violation of Section 16(4) provisions.

We challenged section 16(4) and argued before Honโ€™ble Gujarat High Court in the matter of _M/s Niyati Construction vs Union of India_.

Honโ€™ble Bench heard the matter and issued notices to the respondents. Also directed * the respondents *not to take any coercive steps for recovery*_ till next date of hearing. This is a big relief for the petitioner.

Now the matter is posted on 18th March 2020.
