SC stay on Guj HC judgement on GSTR 3b, Should you be worried?

Did you also claimed ITC considering the annual return date after AAP? Many taxpayers tried to claim ITC left even after the due date of filing GSTR 3b. In the first year of GST the date for claiming ITC was extended and it was extended to 31st March 2019 return due date. Which was 20th April extended to 23rd April. But then the judgment of AAP & company came with huge relief. It scrapped the press release mentioning the 3b date as last date to claim ITC. The date to file an annual return was taken as the last date and many taxpayers claimed their ITCin this period. Although CBIC amended its rules retrospectively and made GSTR 3b , the return required to be filed under section 39. After that, the supreme court provided a stay on that judgment. Now the department will try to reverse all those ITC’s taken after that specified period. 

Let us wait for further developments on this issue.
